Least anyone believe the comparison between Independent Counsel Kenneth Starr and Special Environmental Prosecutor David Irey is overheated or farfetched, please consider the following: In 1995 I assisted in the defense of a small trucking company and some of its employees against an underground gasoline storage tank case brought by Mr. Irey (who was then a San Joaquin County deputy district attorney). In that case, it was conclusively proven that Mr. Irey gave various forms of assistance to attorneys for my clients' opponents in an entirely unrelated civil lawsuit (sound familiar?). I say "conclusively proven" because Mr. Irey was forced to admit his collusion, under oath, at an unprecedented deposition of him and his boss, San Joaquin County District Attorney John Phillips (this was the first time in California history that a sitting district attorney was forced to be deposed by a defendant to investigate allegations of prosecutorial misconduct). I would be happy to discuss Mr. Irey's (and Russell Moore's) conduct in the 1995 case with the Amador County Grand Jury. But don't take my word for this, the facts surrounding the 1995 case are all a matter of public record (People V. Frank C. Alegre Trucking, Inc., et al., San Joaquin County Superior Court Case No. 288794; People V. Superior Court, Third District Court of appeal No. 3 Civ. C0233596.)
